eGift Card Terms and Conditions

General Terms

Lexus Boutique eGift Cards are distributed by BAMKO Merch Inc., a Canadian corporation ("BAMKO"). By visiting www.lexusboutique.ca (the “Merchandise Website”) and purchasing an eGift Card, you hereby agree to the following eGift Card terms and conditions ("Ts & Cs"). These Ts & Cs are subject to change without notice and are applicable in addition to the Terms of Use and Privacy Policy on Lexus’ Merchandise Website.

In the event that any local regulation applies to your purchase of an eGift Card on this site and such regulation is more favorable to you than these Ts & Cs, such law shall supersede the terms herein and govern your purchase to the extent that it is applicable.

eGift Card Ordering and Delivery

eGift Cards may be purchased and used solely on the Merchandise Website and may not be purchased or used on any other of Lexus’ websites. eGift Cards are delivered via email. The buyer will receive a code to apply towards any online purchase above or equal to the value of the eGift Card being used excluding freight.

Payment Methods

eGift Cards may be paid for with a valid Visa, Master Card and\or American Express.

Limitations

eGift cards are redeemable online only. eGift Cards are redeemable for merchandise only and are not redeemable for cash, except where required by law.

Expiration

The eGift Cards will not expire.

Processing or Inactivity Fees

We do not charge any extra fees for non - use or processing.

Lost or Stolen eGift Cards

The value of any lost or stolen cards will not be replaced.

No Warranty

BAMKO MAKES NO WARRANTIES EXPRESS OR IMPLIED WITH RESPECT TO E-GIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Limitation of Liability

IF AN E-GIFT CARD CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT CARD.

Severability

The provisions of this Agreement are intended to be interpreted in a manner which makes them valid, legal, and enforceable. In the event any provision is found to be partially or wholly invalid, illegal or unenforceable, such provision shall be modified or restricted to the extent and in the manner necessary to render it valid, legal, and enforceable. It is expressly understood and agreed between the parties that such modification or restriction may be accomplished unilaterally by BAMKO or alternatively, by disposition of an arbitrator or a court of law. If such provisions cannot under any circumstances be so modified or restricted, they shall be excised from the Agreement without affecting the validity, legality or enforceability of any of the remaining provisions.

Fraud

BAMKO reserves the right to refuse to honor an eGift Card where it suspects that the card was obtained fraudulently.
